What happens if the yacht breaks down during a crewed charter?

If the yacht breaks down during a crewed charter, the owner owes a pro-rata refund of the charter fee for the time lost, or an equal extension of the trip, and a long stoppage lets the guest end the charter and recover the unused days. The MYBA agreement puts numbers on it: a disablement of twelve consecutive hours, or one tenth of the charter period if that is shorter, triggers the refund, and one running past 48 hours gives the charterer the right to terminate in writing. CYBA terms, used by most Caribbean crewed yachts, follow the same principle of refunding the unused portion. Before departure the rule is simpler still. A yacht that cannot sail must be replaced with a comparable boat or every payment returned. Neither contract covers consequential losses, so airfare and hotel nights sit with travel insurance. In practice a broker’s first call is to a sister yacht, not to the clause. The charter contract guide walks through the wording itself.
